The U.S. Equal Employment Opportunity Commission will vote on June 4 whether to rescind a Biden-era strategic enforcement plan and replace it with a national enforcement plan, according to an agency posting Thursday.
At risk is the 2024-2028 Strategic Enforcement Plan, which identified six subject matter enforcement priorities, including protection of “vulnerable and underserved” workers such as immigrant workers, workers with certain disabilities and LGBTQ+ workers, among others.
Since taking the helm of EEOC, Chair Andrea Lucas has changed course on many directives from the Biden administration. Under Lucas, EEOC has followed President Donald Trump’s lead in waging a war on DEI, rescinded its 2024 harassment guidance and pulled back on enforcement of disparate impact liability.
Attorneys for Duane Morris predicted EEOC also will continue its focus on disability, religion and race discrimination claims moving forward.
